This website is operated by Audrey Fine Art (ABN 62 633 287 215), located at Quay Quarter Tower, 50 Bridge Street, Sydney NSW 2000 ("we", "us", "our"). By accessing this website or purchasing from us, you agree to be bound by these Terms of Service. If you do not agree, please do not use this site.

We reserve the right to update these Terms at any time by posting changes to this page. Continued use of the site following any update constitutes acceptance of the revised Terms.

Our online store is powered by Shopify Inc.

Section 1 — Use of This Site

By using this site, you confirm that you are of legal age in your jurisdiction, or that you have obtained parental or guardian consent. You agree not to use this site for any unlawful purpose, to transmit harmful code, or to infringe the rights of any third party. Breach of these Terms will result in immediate termination of your access.

Section 2 — General Conditions

We reserve the right to refuse service to any person at any time. Content you submit (excluding credit card information) may be transmitted unencrypted across various networks. Credit card information is always encrypted in transit.

You may not reproduce, resell, or exploit any part of this site or its content without our express written permission.

Section 3 — Accuracy of Information

Information on this site is provided for general reference only. We make no representations as to its accuracy, completeness, or currency. Reliance on any material on this site is at your own risk. We reserve the right to modify or remove content at any time without notice.

Section 4 — Products, Pricing & Service Changes

Prices are subject to change without notice. We reserve the right to modify, suspend, or discontinue any product or service at any time. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

We have made every effort to display artwork colours accurately; however, we cannot guarantee that your device's display is calibrated to match the original work.

Section 5 — Orders & Billing

We reserve the right to refuse or cancel any order. This may occur where products are mispriced, where we suspect resale, or where we are unable to verify payment details. In such cases, we will notify you promptly.

You agree to provide accurate and current billing information and to update it as necessary. All transactions are in Australian Dollars unless otherwise stated.

Section 6 — Third-Party Tools & Links

This site may include access to third-party tools and links to external websites. We provide these as a convenience only and accept no liability for their content, accuracy, or practices. Use of third-party tools is at your own risk.

Section 7 — User Submissions

Any content you submit to us (including ideas, feedback, or creative materials) may be used by us without restriction or compensation, unless otherwise agreed in writing. You are solely responsible for the accuracy and legality of anything you submit.

We reserve the right to remove any user-submitted content that we determine, in our sole discretion, to be unlawful, offensive, or otherwise objectionable.

Section 8 — Personal Information

Your personal information is governed by our Privacy Policy and handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Section 9 — Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a refund, replacement, or compensation. For minor failures, we are entitled to remedy the issue within a reasonable time.

To the fullest extent permitted by law, and subject to your rights under the Australian Consumer Law, we exclude all implied warranties and limit our liability to the amount you paid for the relevant product or service. We are not liable for indirect, consequential, or special losses of any kind.

Section 10 — Prohibited Uses

You must not use this site or its content to:

–      Engage in any unlawful activity or violate any applicable law or regulation

–      Infringe the intellectual property rights of Audrey Fine Art or any third party

–      Transmit malicious code, viruses, or any harmful software

–      Collect personal information of others without consent

–      Harass, abuse, or discriminate against any person

–      Submit false or misleading information

–      Circumvent or interfere with the security of this site

 

We reserve the right to terminate access for any violation of these prohibitions.

Section 11 — Indemnification

You agree to indemnify and hold harmless Audrey Fine Art, its directors, employees, agents, and suppliers from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third-party right.

Section 12 — Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

Section 13 — Severability & Waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in full force. Our failure to enforce any right or provision does not constitute a waiver of that right.

Section 14 — Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Audrey Fine Art regarding your use of this site and supersede all prior communications and agreements.

Section 15 — Art Styling, Curation & Rental Services

The following terms apply to all art styling, curation, consultancy, and rental services provided by Audrey Fine Art, whether quoted through this website or arranged directly with our team.

15.1  Quotes & Acceptance

All services are provided on the basis of a written quote issued by Audrey Fine Art. Quotes are valid for 14 days from the date of issue. No work will commence until the quote has been accepted in writing (including by email) and the required deposit has been received.

15.2  Deposit & Payment

A deposit of 50% of the total quoted fee is required before any work commences. The remaining balance is due upon installation or delivery of the final artwork selection, unless otherwise agreed in writing. Audrey Fine Art reserves the right to pause or cease work where payments are not received by their due date.

15.3  Payment Obligation Upon Installation

Once artworks have been delivered and installed at the client’s premises — whether as part of an art styling engagement, corporate art rental, or any other service — the full invoice for that installation becomes immediately due and payable. Installation constitutes the client’s acceptance that the service has been rendered and the works are satisfactory.

Post-Installation Review Period.  Audrey Fine Art offers a 48-hour review period following installation during which the client may raise concerns regarding artwork suitability and request a discussion about substitution or adjustment. Any such request must be made in writing within 48 hours of installation completion. After this period has elapsed, the works are deemed accepted without reservation and all invoiced amounts remain payable in full, regardless of any subsequent change in preference or circumstance.

Where an invoice remains unpaid beyond the period permitted under applicable NSW guidelines governing overdue commercial invoices, Audrey Fine Art reserves the right to uplift and recover the installed artworks without further notice. The recovery of artworks does not extinguish, reduce, or otherwise affect the client’s obligation to pay all outstanding amounts, and Audrey Fine Art may continue to pursue recovery of the full invoiced sum together with any reasonable costs incurred in collection and uplift.

For ongoing rental agreements, rental fees continue to accrue until Audrey Fine Art receives written notice of termination in accordance with the agreed rental terms, and the works have been collected by or returned to Audrey Fine Art in their original condition. Notice of termination does not extinguish any amounts outstanding at the time of that notice.

For art styling engagements, if a client requests removal of installed works after installation is complete and outside the 48-hour review period, the full quoted amount remains payable. Any removal, re-installation, or replacement of works following installation will be subject to a separate quote.

Audrey Fine Art reserves the right to pursue recovery of all outstanding invoices, including any reasonable costs incurred in their collection, where payment is not received within the agreed terms.

15.4  Scope & Variations

The accepted quote defines the agreed scope of services. Any request for additional sourcing rounds, revised briefs, additional spaces, or work outside the agreed scope will require a separate variation quote. Audrey Fine Art will seek written approval before proceeding with any out-of-scope work.

15.5  Artwork Sourcing

Where Audrey Fine Art sources artworks from third-party galleries, auction houses, or artists on the client’s behalf, availability cannot be guaranteed and suitable alternatives may be proposed. If a client declines a work that has already been secured or reserved on their behalf, Audrey Fine Art reserves the right to charge a sourcing or holding fee to cover any costs incurred.

15.6  Title & Risk

All artworks remain the property of Audrey Fine Art until payment has been received in full. Risk in the artworks passes to the client upon delivery and installation.

15.7  Damage & Liability

Audrey Fine Art takes all reasonable care during the transportation, handling, and installation of artworks. We accept no liability for damage caused by third-party contractors, builders, or property occupants after installation is complete. The client is responsible for ensuring the installation environment is safe and suitable prior to the agreed installation date.

15.8  Cancellation

Where a client cancels an engagement after the deposit has been paid, the following cancellation fees apply:

–      Cancellation prior to any sourcing or work commencing: 20% of the deposit is retained to cover administration costs; the remainder will be refunded within 14 days.

–      Cancellation after sourcing has commenced but prior to installation: the full deposit is retained to cover work completed, time invested, and costs incurred.

–      Cancellation after installation has commenced: the full quoted amount remains payable.

 

Any third-party costs already incurred by Audrey Fine Art on the client’s behalf — including auction fees, freight, or artist fees — will be invoiced separately, regardless of the stage at which cancellation occurs.

15.9  Photography & Marketing Rights

Audrey Fine Art reserves the right to photograph completed installations for use in its portfolio, website, social media, and marketing materials. The client will be notified prior to any photography. Clients wishing to restrict this right must advise Audrey Fine Art in writing prior to commencement of the engagement.
